These Terms of Use ("Terms") govern your use of the ACTUS LIVE app and related websites (the "Service") provided by Orion Consultings Corporation ("we", "us"). By using the Service you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service, and old enough to form a binding contract (or have a parent or guardian's consent) to purchase tickets. Venue and band accounts must be created by an authorized adult representative.
2. Accounts
You agree to provide accurate information, including a real profile photo of yourself for personal accounts, and to keep your login credentials secure. You are responsible for activity under your account. Venue accounts may be subject to verification.
3. The Platform
ACTUS LIVE is a platform that connects venues, bands and fans. Bookings are agreements between bands and venues, and events are organized by them. We are not a party to those agreements and are not responsible for the performance, quality, safety or cancellation of events, except as required by law.
4. Tickets and Payments
Tickets are sold on behalf of the event organizer. Payments are processed by a third-party payment processor. Prices, fees and refund conditions are shown before purchase. Tickets are personal, may be checked against your profile photo at the door, and may be refused if they are invalid, duplicated or already used. If an event is canceled, refunds are handled according to the refund conditions shown at purchase and applicable law.
5. User Content
You keep ownership of content you upload (photos, music, videos, descriptions). You grant us a non-exclusive, worldwide, royalty-free license to host, display and distribute that content to operate and promote the Service. You confirm you have the rights to the content you upload.
6. Prohibited Conduct
- Creating fake profiles, fake events or fraudulent bookings.
- Reselling, copying or counterfeiting tickets.
- Uploading illegal, infringing, hateful or harmful content.
- Interfering with the security or operation of the Service.
7. Termination
You may delete your account at any time (see Account Deletion). We may suspend or terminate accounts that violate these Terms.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, Orion Consultings Corporation is not liable for indirect, incidental, special or consequential damages arising from your use of the Service.
10. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules.
11. Changes
We may update these Terms. Continued use of the Service after changes means you accept the updated Terms.
